By accessing or using InsulatorOS (the "Service"), operated by Insulate You LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.
If you do not agree to these Terms, do not use the Service.
To use InsulatorOS, you must create an account by providing accurate, complete, and current information. You are responsible for:
One account may represent one insulation contracting business (one "company"). You may invite multiple users under your company account according to your subscription plan's user limits.
InsulatorOS is offered under tiered monthly subscription plans:

Certain plans include a monthly allowance of AI-assisted plan reads (for example, AI-assisted takeoff and plan-reader analyses). These allowances reset on the 1st of each calendar month and are provided on a fair-use basis:

"Unlimited" usage is intended for normal business operations. We may apply reasonable safeguards against abuse, automated bulk processing, or usage that materially exceeds typical contractor activity, and may contact you to discuss appropriate plan sizing in such cases.
If you cancel within the first 30 days of a paid subscription and are unsatisfied, contact us and we will issue a full refund at our discretion. After 30 days, no refunds are issued for partial subscription periods.
When you collect customer payments through InsulatorOS's integrated payment feature, a single all-in processing fee applies per transaction, in addition to your subscription:
These all-in rates cover payment processing, settlement, and platform handling — there are no separate add-on fees. You may pass the processing fee through to your customers at your discretion using the fee pass-through toggle in the invoicing settings.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these restrictions without notice.
You retain full ownership of all data you enter into InsulatorOS ("Customer Data"), including customer records, estimates, invoices, and business information. By using the Service, you grant us a limited, non-exclusive license to store and process your Customer Data solely to provide the Service to you.
We will not access your Customer Data except to provide technical support, comply with legal obligations, or as expressly permitted by you.
The InsulatorOS platform, including its code, design, brand, and IVY AI system, is owned by Insulate You LLC and protected by intellectual property laws. These Terms do not grant you any ownership rights in the platform itself.
The IVY AI Assistant is powered by Anthropic's Claude API. By using IVY, you acknowledge:
We target 99.9% monthly uptime for the Team, Growth, and Enterprise plans. We will make commercially reasonable efforts to provide advance notice of planned maintenance. Scheduled maintenance windows do not count against uptime commitments.
We are not liable for downtime caused by third-party services (Stripe, Anthropic, hosting infrastructure) or by events outside our reasonable control.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INSULATE YOU LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
Either party may terminate this agreement at any time:
Upon termination, you may export your Customer Data. We will retain your data for 90 days after termination to allow for data recovery, after which it will be permanently deleted.
These Terms are governed by the laws of the State of Arkansas, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall first be submitted to good-faith mediation. If mediation fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association in Jonesboro, Arkansas.
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 30 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
